1. This Policy
Jitsu Technologies Inc. (“Jitsutech”) provides and maintains an Online JitsuPRO Solution hosted on Canadian Servers (the “Service”) at www.jitsutech.com and www.jitsutech.ca which allows a subscriber to the service (a “Researcher”) and member of their team (the “Team Members”) to create projects, transmit projects to individuals and to generate reports from the data collected from such projects. In order to provided and maintain the Service, Jitsutech may collect, use and disclose information about the Researcher and Team Members (“Personal Information”). This policy sets out how Jitsutech collects, uses and discloses the Personal information pertaining to Researchers and Team Members, each of who are a “User”.
2. About Respondents
Researchers use the Service to collect personal information from project respondents (“Respondents”). Under Jitsutech’s Terms of Use, all such Respondents information is under the control of the Researcher, and the Researcher is responsible for its proper collection, use, disclosure, retention, and destruction in accordance to applicable law. Jitsutech acts as a provider to the Researcher, under the direction and control of the Researcher, to the extent Jitsutech has custody of any such Respondent Information on the Service. Jitsutech does not independently access, use or disclose any such information in any way, except as necessary to maintain and support the Service. All Respondent inquiries concerning their information should be directed to the relevant Researcher.
3. Consent
When a User registers for an account, creates a username and password and/or uses the Service, they may be providing Personal Information to Jitsutech. By registering for an account, creating a username and password, accepting the Terms of Use and/or using the Service, the User consents to collection, use and disclosure of their Personal Information by Jitsutech in accordance with this policy, and represents and warrants that any necessary consent has been obtained from any other person whose Personal Information is provided to Jitsutech.
4. Collection, Use and Disclosure of Personal Information
Any Personal Information regarding Users that is provided to Jitsutech may be used for the purposes of providing, maintaining and developing the Service, processing payments for subscription to the Service, providing reports and other purposes connected to these. Jitsutech limits its collection to information that is necessary for these purposes. For any other purposes, consent of the User would be obtained.
Jitsutech may use Personal Information regarding Users to contact them from time to time regarding the Service, but will not provide such Personal Information to third parties for marketing or spamming purposes. Use inside Jitsutech is limited to necessary staff on a need-to-know basis.
Personal Information may be transferred to third parties for the purpose(s) of hosting the projects; data storage; providing technical support; troubleshooting; management or maintenance of the Service, or other purposes reasonably connected to these. These third parties may be located in other provinces in Canada. Personal Information may also be disclosed to law enforcing agencies or other parties, as required or permitted by applicable law. Jitsutech may also use and disclose Personal Information as required or permitted by applicable law, for example in response to a court order.
5. Anonymity
Jitsutech does not use “Cookies”. A cookie is a small file stored on a computer by a web browser when using some internet sites. Cookies can also store non-Personal information. Jitsutech does not link non-Personal information from Cookies to a User’s or Respondents Personal Information.
User’s should review the privacy policy of other Software Websites to understand how these other sites use Cookies and how they use the information they collect through the use of Cookies. Jitsutech does NOT collect information for personal or re-sale reasons such as:
- Tracking Respondent IP Addresses
- Tracking Respondent Location
- Tracking Respondent Geo Location
- Tracking Respondent Web Browser
- Tracking Respondent Operation System
- Tracking Respondent Historical Data
- Tracking Respondent Online Habits
6. Retention
We will keep Personal Information only as long as it is necessary to satisfy the purposes for which it was obtained or as required by law or standard business practice. Where personal information is no longer required to fulfill the identified purposes, it will be destroyed, erased or made anonymous.
7. Accuracy
We will use our best efforts to ensure that Personal Information is accurate, complete, and up-to-date as necessary for the purposes for which it is to be used. A User is entitled to seek a correction of Personal Information if they believe that the information in our possession is not correct.
8. Safeguards
Jitsutech will not use, reproduce, distribute, modify, adapt, create derivative works, make publicly available and otherwise exploit your Content while using our services or after you have stopped using our services. We will protect Personal Information with safeguards appropriate to the sensitivity of the information. Our safeguards will protect against Personal Information against loss or theft, as well as, unauthorized access, disclosure, copying, use or modification, regardless of the format in which the information is held.
9. Access to Personal Information
A User may access Personal Information that is under Jitsutech’s control by submitting a written request to Jitsutech’s Privacy Officer. With certain exceptions, within 30 days of receiving a written request, Jitsutech will provide:
- A summary of their Personal Information that is under Jitsutech’s control;
- The ways in which the Personal Information has been used by Jitsutech; And
- The names of any individuals or organizations to whom Jitsutech has disclosed the Personal Information.
A user may address any concerns about any of their Personal Information under Jitsutech’s control by submitting a written request to Jitsutech’s Privacy Officer detailing such concerns.
10. Withdrawal of Consent
A User may withdraw their consent to Jitsutech’s use and disclosure of their Personal Information by making a written statement to Jitsutech’s Privacy Officer. Upon receiving such written statement, within a reasonable amount of time, Jitsutech will make reasonable efforts to delete or render anonymous the Personal Information that is under its control. This may result in User’s ability to access the Service and/or deletion of a User account.
11. No Control over Other User’s Compliance with Privacy Laws
The access provisions in section 9 and the withdrawal of consent provisions in section 10 of this policy apply only to Personal Information that is under Jitsutech’s control. Jitsutech is not responsible for any Personal Information that is not under its control, including any Personal Information that has been disclosed to other Users that have access to an account. If a User wants to access, correct, or withdraw consent to the use and disclosure of any Personal Information that is under the control of another User, they must contact the User directly.
12. Team Members Consent and Withdrawal of Consent
Jitsutech’s Terms of Use require that the Researcher has consent from each Team Member to include the Team Member’s name and email address in an account’s Team Member account section. If a Team Member has not provided consent or wish to withdraw consent to the inclusion of their name and email address in an account Team Member section, they should contact the Researcher. If the Researcher does not respond to the request of removing the Team Member from the Team Members Account section, a report should be then made directly to Jitsutech’s Privacy Officer.
13. Mailing List
Jitsutech maintains an “opt-in” mailing list, and any person can subscribe to the list by following directions on Jitsutech’s website. Subscribers consent to receiving emails and other communications from Jitsutech from time to time concerning developments at Jitsutech including Service improvements and new product offerings. Instructions on how to unsubscribe from the mailing list are available on the website.
